Debt Recovery FAQs

Common questions about the recovery process, timelines, and legal framework.

Answers to the questions creditors ask most. If you don't find what you're looking for, our team is a message away.

The Recovery Process

Timelines vary significantly based on debtor responsiveness, jurisdiction, and case complexity. Amicable recovery typically resolves within 30–90 days. Cases requiring legal escalation through Statutory Demands or winding-up proceedings can take 3–9 months. We provide a realistic timeline assessment after reviewing your case.

A specialist reviews your submission within one business day. If the case is viable, we conduct a pre-litigation assessment, confirm engagement terms on a contingency basis, and assign a case manager. You receive a case reference and direct contact for your assigned team.

Yes. Contracts, invoices, correspondence, and any prior recovery records strengthen your position. You can upload these securely through our Document Center once your case is active. The more documentation we have, the stronger the recovery position.

We specialize in cross-border recovery. While our enforcement actions are grounded in Hong Kong law, we trace assets and coordinate with local counsel across jurisdictions — particularly for South Asian diaspora and Western expat debtor profiles.

Fees & Engagement

We operate on a contingency basis — our fee is a percentage of the amount recovered, agreed upfront in your engagement letter. If we do not recover, you owe no fee. We carry the risk of recovery so you can pursue what you are owed without upfront cost.

No recovery, no fee. In some cases involving formal legal proceedings (Statutory Demands, winding-up petitions), disbursement costs such as court filing fees may apply — these are always disclosed and approved by you before any cost is incurred.

Contingency rates depend on case complexity, debtor jurisdiction, debt age, and asset recoverability. Rates are negotiated transparently during engagement and documented in your engagement letter before any work begins.

Legal Framework

Our toolkit includes Statutory Demands under the Companies Ordinance, Section 178 winding-up proceedings, bankruptcy petitions, and judgment enforcement. We escalate proportionally — amicable negotiation first, formal legal action only when necessary.

Absolutely. Every engagement adheres to the Personal Data (Privacy) Ordinance (Cap. 486), the Companies Ordinance, and all applicable Hong Kong regulations. Our processes are documented, audited annually, and reviewable by partners.

Yes. Where a debt is undisputed and exceeds HK$10,000 for an individual or the relevant threshold for a company, we can prepare and serve a Statutory Demand. This is a powerful pre-litigation tool that often prompts payment without court proceedings.

Data & Privacy

All personal data is handled under strict PDPO (Cap. 486) compliance. We collect only what recovery requires, retain it no longer than necessary, and never disclose data to unauthorized parties. Documents are stored securely with access controls.

Yes. Under the PDPO's Data Protection Principle 6, data subjects have the right to request access to and correction of personal data held about them. We have a designated process and Privacy Officer to handle such requests.
