Terms & conditions for platform use.
These terms establish the legal framework for creditors and debtors using the Canton Recovery platform for cross-border debt recovery and commercial mediation services.
Last updated: October 2026. By using the Canton Recovery platform, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree, please discontinue use of the Platform.
1. Acceptance of Terms
By accessing or using the Canton Recovery platform (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not access or use the Platform. These terms apply to all users including creditors, debtors, agents, and administrators.
2. Creditor Obligations & Representations
Creditors represent that all claims submitted are valid, legally owed, and supported by adequate documentation. Creditors agree to provide accurate debtor information, disclose any prior recovery attempts, and authorize Canton Recovery to act as their agent in recovery proceedings. Creditors acknowledge that recovery outcomes are not guaranteed and depend on debtor circumstances, jurisdictional constraints, and applicable legal frameworks.
3. Debtor Obligations & Rights
Debtors agree to engage with recovery communications in good faith and to provide accurate information regarding their financial circumstances. Debtors retain all rights under Hong Kong law, including protection from harassment, the right to dispute inaccurate claims, and the right to seek independent legal counsel. Canton Recovery conducts all recovery activities in compliance with the Money Lenders Ordinance and applicable fair collection practices.
4. Service Fees & Contingency Arrangements
Canton Recovery operates on a contingency fee basis unless otherwise agreed in writing. The contingency percentage is specified in the engagement letter signed prior to recovery commencement. Fees are payable only upon successful recovery. Creditors are responsible for any legal costs incurred during legal escalation, as disclosed and approved prior to initiation of proceedings.
5. Confidentiality & Data Protection
All parties agree to maintain the confidentiality of case information, debtor data, and recovery strategies. Personal data is processed in accordance with the Hong Kong Personal Data (Privacy) Ordinance (Cap. 486). Our full data handling practices are detailed in our Privacy Policy. Unauthorized disclosure of case information to third parties is prohibited.
6. Prohibited Conduct
Users may not use the Platform to submit fraudulent claims, provide false or misleading information, impersonate another party, or attempt to circumvent the Platform's access controls. Canton Recovery reserves the right to suspend or terminate access for any user engaged in prohibited conduct, and to report fraudulent activity to the relevant authorities.
7. Limitation of Liability
Canton Recovery provides recovery services on a best-efforts basis. To the maximum extent permitted by law, Canton Recovery shall not be liable for indirect, incidental, or consequential damages arising from the use of the Platform or the outcome of recovery proceedings. Total liability is limited to the fees actually paid by the creditor for the engagement giving rise to the claim.
8. Term & Termination
Either party may terminate the engagement with written notice subject to the terms of the signed engagement letter. Upon termination, Canton Recovery will provide a final accounting of all recoveries and outstanding matters. Provisions relating to confidentiality, liability, and governing law survive termination.
9. Governing Law & Dispute Resolution
These Terms of Service are governed by the laws of the Hong Kong Special Administrative Region. Any dispute arising from or relating to these terms or the use of the Platform shall be resolved through good-faith negotiation, followed by mediation if necessary. Failing resolution, disputes shall be submitted to the exclusive jurisdiction of the Hong Kong courts.
